Statute

1 Purposes

The Centre aims to integrate research groups and other international, national and local bodies engaged in analysis and researches about different forms of knowledge and, overall, in their circulation inside the Mediterranean basin, in order to build instruments for the planning, the management and the evaluation of local actions able to produce a positive effect on the Europeanization and on the perception of Europe by the citizens

In the implementation of his activities the Centre will interact with Universities, Research Institutes, Public and Private Bodies able to contribute to the attainment of the purposes, also through specific didactical activities and researches.

2 Activities

Purposes in §1 shall be pursued by the following activities:

  • Promoting international action-research projects, which enable comparative studies about the evolution of methods and instruments of circulation of the knowledge and, in particular, of the Mediterranean cultural heritage.
  • Organizing the international congress about “Knowledge of the Mediterranean”, that will be yearly held in a place where is located one of the associated Bodies.
  • Organizing seminars on specific subjects, where scholars and local actors could interchange their own knowledge and their own opinions;
  • Implementing projects of high education postgraduate (such as master’s programs and PhDs), connected with the subjects related to the “Mediterranean knowledge”, with the participation of the national and international partners of the Centre.
  • Hosting postgraduate students (PhD and post PhD), for the elaboration of their dissertations.
  • Editing journals and essays, also by specific actions, in order to permit the useful results to reach local actors and decision makers

Study and research activities shall be wide and articulate, envisaging to realize international level products. The aim is to contribute, in an original, innovative and scientific way, to the progress of the state of the art and to promote a lead role for the University of Salerno in the international scenario of the research.

The Centre might provide services to public and private bodies by the drafting of specific agreements.

The Centre might join international, national and local projects, promoted by public and private bodies.

3 Main administrative office and structure

The main administrative office of the Centre is located at the University of Salerno, Department of Human, Philosophic and Formation Sciences (DISUFF). At the expiration of the present agreement the main administrative office can be moved to another affiliated University or Body, upon majority decision of the Governing Council.

For the development of his activities Centre is structured in Research Units, located at Universities, Research Institutes and other Public and Private Bodies, according to the following § 4.

Activies are implemented by Research Units, also in cooperation with other research bodies or groups, in accordance with the guidelines proposed by the Scientific Committee, according to the following § 8.

4 Affiliations

Each University, Research Institute and Public or Private Body shall join the Centre through a Research Unit, composed by scholars specialized in the Centre’s topics. Scholars of Universities, Research Institutes and other Public and Private Bodies could be affiliated to the Centre through a Research Unit upon approval by it and, at a later stage, by the Governing Council.

5 Authorities

Authorities of the Centre are:

  • The Director
  • The Governing Council
  • The Scientific Committee
  • The Chairman of the Scientific Committee

6 The Director

The Director is appointed by the Rector of the University where the main administrative office of the Centre is located, upon proposal of the Governing Council. The Director serves for a term of three years and can be eligible to reelection.

The Director promotes and coordinates the activities of the Centre. In particular the Director:

  • Is responsible for institutional relationships;
  • Is a member of the Governing Council;
  • Calls the Governing Council and promotes his activities;
  • Is responsible for the fulfillment of the Centre’s purposes;
  • Signs contracts and agreements;
  • Submits to the Governing Council, for examination and approval, all that is under jurisdiction of this authority – related to the administrative and financial managing – under the Regulation in force at the University where the main office of the Centre is located;
  • Presents to the Scientific Committee an yearly report about the activities of the Centre:
  • Supervises the general operation of the Centre.

7 The Governing Council

The Governing Council serves for a term of three years and is composed by a member for each Research Unit, by the Director and by the Chairman of the Scientific Committee.

The Governing Council assembles at least three times a year, upon call of the Director, that chairs it, or upon request of at least one third of the members.

Meetings are valid if more than half of the members is present and can be held by electronic means. Excused absentees are excluded from the calculation.

The Governing Council shall act by a simple majority. In the event of a tie, the Director has the casting vote.

The Governing Council:

  1. Proposes the appointment of the Director to the Rector of the University where the main office of the Centre is located;
  2. Decides about the activities of the Centre, according to the guidelines proposed by the Scientific Committee;
  3. Decides about amendments to the present statute and about additional instruments;
  4. Decides about the administrative and financial management, under the Regulation in force at the University where the main office of the Centre is located;
  5. Decides about the Research Units and about the affiliations referred to the § 3, 4 and 12;
  6. Decides about the location and the management of the equipment of the Centre;
  7. Decides about any other matter submitted to it by the Director.

8 The Scientific Committee

The Scientific Committee is composed by members appointed by every Research Unit and can include external expert and/or scholars with the highest reputation.

The Scientific Committee shall elect a Chairman that chairs and coordinates the meetings.

The Scientific Committee has tasks of guidance and is called by the Chairman, regularly twice a year and every time the call is requested by at least one third of the members or by the Director

Meetings are valid if more than half of the members is present and can be held by electronic means. Excused absentees are excluded from the calculation.

The Committee shall act by a simple majority. In the event of a tie, the Chairman has the casting vote.

The Scientific Committee:

  • Decides about the guidelines of the Centre’s activities;
  • Promotes initiatives for the scientific dissemination and for coordinating the activities;
  • Exercises its advisory functions about all subjects submitted by the Governing Council

9 The Chairman of the Scientific Committee

The Chairman of the Scientific Committee is elected by the Scientific Committee, serves for a term of three years and can be eligible to reelection.

The Chairman of the Scientific Committee chairs and coordinates the meetings of the Scientific Committee. In particular the Chairman:

  1. Is a member of the Governing Council;
  2. Assists the Director in the performance of his tasks;
  3. Ensures that structures and activities are in compliance with the guidelines established by the Scientific Committee;
  4. Acts for raising of additional funds for the pursuit of the objectives of the Centre.

10 Use of premises, equipment and staff

Universities, Research Institutes and other Public or Private Bodies affiliated to the Centre can assign to the Centre premises and equipment for the pursuit of the institutional purposes.

Centre equipment shall be located and managed in accordance with the rules established by the Governing Council.

For the implementation of his activities the Centre can count on the affiliated staff and also on:

  1. Scholarship holders and research fellows;
  2. Fellows seconded by the CNR or from other Italian or foreign Bodies;
  3. Contractual staff for the provision of technical and organizational services.

11 Funding and administration

Centre runs with funds from:

  • Ministero dell’Istruzione, Università e Ricerca (MIUR), through the budget for scientific research allocated to national projects or through special funding;
  • Any contribution from the affiliated Universities, provided directly or through the affiliated Deparments;
  • Consiglio Nazionale delle Ricerche (National Research Council);
  • Contributions provided by members from local university research funds or from other funds whose they have full availability;
  • Research Bodies and International or European Authorities, through national and international agreements;
  • Other private and public Bodies or Institutions, active in areas of interest of the Centre;
  • Contributions for the performance of the activities of the Centre;
  • Active contracts.

Funds assigned as above shall flow to the main office, with target constraint.

As for the administrative and financial management, the Regulation of the University where the Centre main administrative office is located shall be in force, considering that organizational support is provided by from the Department acting as a main administrative office.

In the event of termination of the Centre, properties shall remain owned by the affiliated Universities or by the Departments in charge of them.

12 New accessions

The list of scholars affiliated to Research Units, updated according to § 4, shall be approved by the Governing Council.

The Centre can be joined by other Universities, Research or High Education Institutes, Public and Private Bodies active in Centre’s areas of expertise, that send formal application to the Director.

New accessions are submitted for the approval to the Governing Council and are formalized by special additional acts.

13 Term and termination

The present agreement shall enter into force on the date of signing and remains valid for a term of six (6) years, it shall be renewable for an equivalent term by written agreement between the parties, approved by the respective authorities.

Withdrawal of any University, Research Institute or other Public and Private Body shall be acceptable, by notice of termination sent at least three months before the expiry.

14 Termination of the Centre

The Centre shall terminate:

  • For the achievement of its purposes;
  • For the expiry of the term;
  • For supervening impediments due to serious and persistent reasons.

Termination is declared by the Rector of the University where the main administrative office of the Centre is located. In the event of termination the Director shall send to the Rector the statement of the financial position of the Centre.

15 Amendments to the Agreement

Amendments to the present agreement shall be delivered by an absolute majority by the Governing Council and shall be submitted to the affiliated Universities in order to be approved by their respective decision-making bodies.

16 Reference rules

All that is not expressly mentioned in the present statute shall be defined by special regulations, in accordance with the Statute and with the Regulations of the University where the main administrative office of the Centre is located

17 Transitional rules

For the first application of the present agreement, the Research Units composed by the scholars set out in annex A are affiliated to the Centre.

It is responsibility of these Units to compose the Scientific Committee and to appoint the members of the Governing Council within thirty days since the entry into force of the present agreement; the Governing Council, convened by its senior member, proposes within thirty days the appointment of the Director to the Rector of the University where the main administrative office of the Centre is located.

18 Disputes

For any dispute arisen among the parts about the application, the interpretation, the implementation and/or the validity of the present agreement, if the parties won’t be able to solve it in a friendly way, the competent jurisdiction is competent jurisdiction for the main administrative office of the Centre.
